Terms of Service — ecomwiz

1. The service

ecomwiz is a Software-as-a-Service that generates AI lifestyle product images and pushes them to a connected Shopify store. The service is provided by Ondřej Filipi, IČO: 14336561, Czech Republic (the "Provider"). You (the merchant) are the "Customer".

2. Plans and billing

Free trial

Every new install receives 10 generation credits. Credits never expire.

Project packs (one-time)

• Mini Pack — $29 — 20 credits
• Mini Shoot — $299 — 200 credits
• Catalog Shoot — $799 — 1500 credits
• Pro Shoot — $1999 — 5000 credits

Packs are non-recurring. Credits granted at purchase, never expire as long as the app is installed.

Retainers (recurring)

• Starter — $19/mo — 25 credits/mo
• Auto-Refresh — $39/mo — 100 credits/mo
• Always-Fresh — $99/mo — 400 credits/mo
• Brand Engine — $249/mo — 1500 credits/mo

Subscriptions auto-renew through Shopify's billing system. You can cancel any time; your current period stays active.

Refunds

• One-time packs: refundable within 30 days for the unused portion pro-rata by remaining credits.
• Subscriptions: non-refundable. Cancellation takes effect at the end of the current billing period.
• Provider failures: failed generations are auto-refunded as credits.

3. AI-generated content

Outputs are generated using third-party AI models (Seedream, Flux, Nano Banana, GPT Image, Ideogram). The Customer:

• owns the rights to upload outputs to their store and use them commercially in their storefront, ads, and marketing;
• is responsible for complying with local AI-disclosure laws (EU AI Act Article 50, Czech equivalents);
• agrees that the Provider does not warrant that outputs will be identical to the original product, fit-for-purpose, or free from unintended artifacts. The Customer is expected to review outputs before pushing them to the storefront.

4. Acceptable use

You may not:

• Use ecomwiz to generate images of real persons (other than yourself) without consent.
• Use it for sexually explicit content, hate symbols, or any content that violates Shopify's Acceptable Use Policy.
• Resell access to the service.

We reserve the right to terminate accounts that violate these terms.

5. Liability

To the maximum extent permitted by law, the Provider's aggregate liability is capped at the amount the Customer paid for the service in the preceding 12 months. We are not liable for lost profits, indirect damages, or harm caused by AI hallucinations the Customer chose to publish.

6. Term and termination

The agreement runs for as long as the app is installed. Either party may terminate at any time. On uninstall, we follow the GDPR data retention timeline described in our Privacy Policy.

7. Governing law

These Terms are governed by Czech law. Disputes go to the courts of Prague unless mandatory consumer protection law dictates otherwise.
